Two thumbs up for the Washington County Sheriffs Dept...
Our daughter, who is a new cardholder, and is trying to grow her own...Was turned in by an unknown caller... Reported a major grow operation across from a pre-school... The Sheriffs showed up this morning, and found her in compliance. They are however doing a house search, for who knows what...
I talked to them, and told them," as long as she is in compliance with the amount of plants, she can legally grow indoors..." Even next to a pre-school, grammer school, middle school, high school, trade school, etc!!!! Was told it's a little complicated, but she will be found in compliance and left alone...

I am glad they are doing things according to the law. It is after all their job. However, I have a question...what's with the house search? This should NOT happen.
If she is in compliance, they should have a warrant to come in. That warrant would spell out, what they are looking for and, where they are allowed to look for it. This is for the protection of all involved.
If there are extenuating circumstances in this incedent, such as the mj rumor compounded with rumors of other illegal activities, then the search of the house may be warranted by the cops. Note the use of the word "warranted."
To allow them full search of the house on a knock and talk, is my opinin, totally uncalled for and ill advised at this time.
I will withhold my applause for the cops in this one.

I have to agree with Alpha and Sequoia: The police should not be rifling through your daughter's things without a warrant. It is important to make them do their jobs and gat a warrant. Sequoia is right, the judges will get tired of writing out warrants for law-abiding citizens.

Hello all,
A little hectic over here with the tribe, but, I'll try to explain what happened as best as I can...
My daughter was home alone and being newer to the program was scared... She was told someone complained of the smell... Had no warrant and tried to force his way in... My daughter said "No way you're coming in here" and shut the door... The officer said he would lock her in and get a warrant... She said "go ahead..."
The next thing she knew, her boyfriend/grower comes home and they follow him in... So to answer the question, by the time I got there, the Sheriff's said she was in compliance and was okay... After they left, we found out, they had her sitting in her livivg room while they searched her apt...
She did have 3 plants over that were 2 inches too tall... They took the plants, and told her they were turning the case over to the Feds... To see if they want to prosecute her and her boyfriend for growing within 1000' of a school!!! Sound familer??? This is even after I informed him, she "Could" grow within the distant as long as she had the legal # of plants...
Hers is a closest grow in the backside of their apt. away from the school...
That's about the size of it... She had very little meds including the trim from her last harvest and a broken scale they took pictures of...
So now, my daughter and her boyfriend want the name and # of a good lawyer, because they have complaints about what happened to them... So hold your round of applause for now and we'll see what happens next....

This is the exact reason the compliance needs to be defined in greater detail. 12" is nowhere near mature plant IMO. Anyways.
Bout the cops. Here's the thing. If you think your gonna be a martyr and stand up for your rights and make them go get a warrant which they would have. THEN they will not be nice when they come back. Its not uncommon for a house to be torn to shambles during a search like this not to mention they DONT KNOCK!!!!!! The bust your door down screaming POLICE POLICE POLICE and then you get AR-15s in your face and thrown to the ground.I think the bf did the right thing by letting them in. To their knowledge they were in compliance. And if they arent going to bring local charges then it sounds like it will all just go away(optomistic).

Thanks all... They threatened to lock down her building and surround her house, for at least 6 hours until a warrant got there.... Said they were coming in one way or the other... So, in the long run, they did make the best choice at that moment... As they believed themselves to be be legal...
The threat was about being across from a pre-school... The threat of jail time still has her spooked... I'm working on explaining what I know of the law... But, having them come up in plain clothes, and not ID themselves until she said they couldn't come in, sounds a tad shady on their part to me!!! They asked for her boyfriend by name, she said he was at work, they asked to come in and wait... She asked who they were, they answered Dep. so- and- so... She said they couldn't come in, and that started all the rest...
That's all the new news... I'll keep you posted... They were wondering if anyone else gets hassled like this? Peace all and keep legal..

I had a knock and talk by the clackamas county sheriff.It was about 10 minutes long. Cops were great too. They didnt make any threats or anything just asked to see my garden only. Didnt want to see the rest of my house. So I let em in and they said good job and left.

everybody, and i do mean, everybody...needs to write to our fed reps, our local legislators across this state, the governor and state att'y general..we cannot sit passively by and live with this kind of fear. this is a criminal WASTE of tax dollars and really a TERRRIBLE way to treat sick people. WTF!!!!...if we dont pick up the reins this "wagon" is gonna go right off the cliff. write to your reps...THE ONLY WAY WE ARE GOING TO GET SICK AND DYING PEOPLE OFF THE RADAR IS TO START WRITING AND VISITING THESE PEOPLE. they havethe power to change the leo priorities but they WILL NOT untill we MAKE THEM. they work for us! lets make them do the job to the satisfaction of the people. i cannot imagine that even those who are not for med cannabis would continue to SUPPORT this WASTE OF TAX DOLLARS. it their money too. its our lives. if we do this as a "whole" then the whole will benefit, in others words the action you take now may prevent you from becoming another ganjarob and bw daughter..so whats it gonna be??? an ounce of prevention? or just hope that you wont get "the visit"?

ARRRRGH!! This is intimidation and harassment of OMMP members. It would be nice to organize an email write in to the chief of that precinct and state reps. PS.. We believe the apt. managers might have called, they knew my daughter was growing... Asked for bud on several occasions and was told no... The last time was the night before the police showed up... Now they're not speaking to me or Grandma either.... Kinda interesting twist, if it's true....

if we want change we will have to work for it. it will not just come to us. the lawmakers have the power we gave them to accomplish this. we gave them their powers and authority, what we the people have failed to do, is to "supervise them", hold them accountable and become involved with them to be sure that they are representing all people.

Joe I`m curious, when the police came on a knock and talk what did they say the reason was? How did they know you were growing, did they check with the state first, did they ask to see your card? These are important things and I think alot of people would like to know not only that they are doing these things but how they are doing them. Thanks for filling us in on this.

Please be sure if and when you write, if you are referring to specific case, that you have your ducks in a row and know of what you speak. Be sure you aren't defending someone who is actually guilty of criminal activities you might not be aware of.
Of course, I am in now way inferring anything specific to this case. Absolutly not! What I am saying is , your message or comlpaint about general policy may have more credibilitly than if you singled out a case that, on the surface seemed to illustrate your point, while actualy because of its true nature ...detracts from your cause.
Your letter is a great way to have your voice heard by the actual people involved with this issue! If you aren't from the county in question, it will wake em up to the fact, they aren't operating in insular environment. In the meantime....teach them how to treat you. I think life is like that...you gotta teach em how to treat ya. Law enforcement (particularily local) is sworn to protect, serve, and enforce. They sometimes fall to the temptation to become a bit unbalanced with the enforcement part. It is our duty as citizens to keep em reigned in. Power to the Populace!

Well at thw time I was renting from a friend of the family (never again). And I had just got my card. My wife thought since it was his property we should run the idea by him and see what he thought. I was completely against it. She went ahead and told him. Turned the guy was cool and said fine let me see your card so I know your legit and its all cool. Everything seemed fine. Then he started getting distant and short with us. Then the cops show up. The officer Brandon Clagget I believe his name was said he had recieved an anonymous tip that I had a MAJOR marijuana growing operation going on. He was aware I had a card and asked to see it. So I gave him my card. He looked at it wrote the number down and handed it back Then he asked if he could come in. I was reluctant to cooperate after al these are the cops right? So after pondering on it and gettin sick and tired of tryin to dodge his ever attempt to look at my grow I said sure. I told him that it was to be him and one other officer to enter my house and I pointed the guy out. I then told em they could only look at my grow. He said thats all he was there to look at. Didnt care to see my house. So they came in and in no more than 5 min they were gone. He left me a business card adn told me he thinks the nieghbors(our landlord) are growing marijuana and to call him if I see anything suspicious. And thats was the last I heard from Deputy Clagget. Like I said though real nice guy. Wasnt intrusive or anything. Just came in looked and left. The cops arent all bad guys. There are others like Deputy Clagget out there Im sure of it. The thing is the cops arent as clear on teh law as we are too. He had to ask me about particular parts of it because he was confused a bit he said.

They first told me, she was in compliance and they'd let her be... As I was leaving, a female officer came in with a big brown bag and a tape measure... Later we found out from our daughter, she had 3 plants that were over the 12 x 12 law in veg.... All 3 were just a couple inches over, but that was enough... They took the plants she was over, which brought her to the point they were satisfied and left... On the way out the door,she was informed,they would be turning it over to the feds for being within 1000' of a school...
Hope that clarifies things a little better for you... Being new, she didn't realize the plants were that tall... A couple of inches, and that's all it took... So, everyone beware of the size of your vegging plants, they do have tape measures they just love to use...

Np. Mine was many months ago but still it went smooth. This thing that people voted in for the 24/24 is ridiculous. It almost seems it was better the other way because it was real simple to tell if you were in compliance or not. Something has got to change or we're gonna see more victims like BW's daughter/boyfriend. If I remember right isnt there one of those ACMM meetings coming up? May be a good place to get the ball rolling if it hasnt already been set in motion. When the law first came into affect i had had my card for like 2 months so I was like cool thats awesome more = better right? Well I soon came to find out thats not the case. Ive personally killed more plants than I have flowered because of this law and thats a shame in itself.

Upon the advice of a lawyer... Our daughter feels sooooo much better... She was told, if they
come back, call him and vidoetape the whole thing... And, "Never, Never" open the door, until she
sees a warrant through the peep hole... Everything that was done, from the time she opened the
door, until the time they left was illegal... Her having 3 plants, a few inches over was nothing to
worry about... So there you go folks... This morning our daughter woke to find 2 of her plants had
grown almost 3 inches overnight and got sick.... Got out her trimmers and shaved her down to
10x10 she said... LOL... At least she's on guard now, as should all you growers/caregivers... (Bless

I reiterate my formerly stated position...in spite of advice otherwise and anecdotal info of "pleeasant" knock and talk experiences. Warrant, warrant, warrant! Make em comply! Screw that crap about locking you in your house and coming in later and tearing shit up. When they are knocking....insist on a warrant. Not ol Alphamale posturing...simple instructions from qualified attorney....do NOT let them in without proper warrants.
Not all cops are ornery. Not all cops are out to screw ya. All cops have a job to do. They don't always choose to follow the rules. You must insist and protect YOUR rights. You don't have to be obnoxious about it....they understand..hehehehheh. They just want to find any little tiny excuse to ruin your life. It's what they do. Intimidation is their forte. If you are innocent or even suspect you are innocent....insist on your rights. One of the most basic, is the right to privacy in your home. Teach em how to treat you.

during this whole process many of us that opposed this bill repeatedly advised them this kind of crap would happen...

The best way to handel this in my opinion is to not even open the door... show them the card thru glass or a locked screen door & them tell them you have to speak to your lawyer before you ansewer any?'s or they enter, unless they have a warrent. Then call a lawyer immeaditly!
I have a strict ,I've shown you mine(my card) now show me yours (a warrant) policy!
If they want to surround the house fine but your not comming in without a warrant period, If they dont like it sorry ...I have to follow the law & so do the police. I have a feeling that if you had your lawyer on the phone they would have ben alot more carefull about threating or harrassing & would crossed their "T's" & dotted their "I's"
Its inparitive that we let LEO know that we know what our are rights are & we will fight to protect them!
It is not acceptable to harrass,threaten,or intimmadate sick people by anyone ,yet alone the poeple whos job it is to protect law abidding citizens.
