Can I help out another patient with their garden without being listed as their grower? Not just moral support, I mean I intend to physically help them out as it is an older person and we'll be dealing with lots o' dirt! :D I don't want to potentially get anyone into trouble....
Thank You,
TS

You have a card....as long as you are there and the garden is legal....not a problem.

I do not think the legality of helping a patient garden is really settled. If you have a card and are helping someone with what is obviously their garden then common sense would seem to be that you can help them. However I am not sure how an overzealous prosecutor like Katie Suver might interpret this.
I think it rarely if ever comes up due to the private nature of the behavior.
There was however a case that went all the way to the Oregon Supreme Court where a person (non cardholder) was convicted of possession for helping a cardolder move plants. The cardholder was in the car with the noncardholder who was convicted. Seems incredibly unfair but it happened.
I'm not suggesting that you don't help, just be discreet.

That is on the back of the form.
It is for all the people living at the site but it does not protect you from the law.
HOWEVER
As long as you are AT the growsite, not driving around, there should be no problem.
To start with how would anyone know unless you told them???

Is it still on the back of the form? I looked online and as they have changed the forms I don't see it anymore....

yeah I think they closed that loophole. Tom Servo as a CARDHOLDER you are good to go to help in any other cardholder's garden... if someone doesn't have a card they should not get involved.

Don't the garden geeks go to others growrooms and help them out? It must be ok if that is the case. ogf would not be involved in illegal acticity

Listing the people that may be living at the growsite that remain uncarded, may come in handy to stop a frequenting charge if it came to that or to help protect syblings that are right at that questionable age 13-17...
It also may take away the fact that that person may not be considered the 'public' and can look but not touch. In a way the problem with case
rancher relates but that person had physical control or possession because
he was just helping a person carry them.

they removed that option from the application... I am pretty sure you can't list the non cardholder's anymore

Common practice is cardholders help each other all of the time.
As far as I know, there is no law which states that only the registered prmgs, caregivers or patients are allowed in the garden they are registered to.
If you were working in a garden and leo showed up and the garden is out of compliance or the owner of the garden has a meth lab in the house, not sure how that would play out.
On another note, sometimes you have to let the electrician or the furnace repair guy in.
I do not know if they are protected under the law.
Be careful, be smart, be honest and you are probably fine within the community.
Smart means you do not work in a 1000 plant garden next door to a school:D
What I am wondering is this,
I know it is not okay for prmgs to charge for labor or to pass that expense on to the patient if they do.
However, as a patient, sometimes I need help in the garden and am willing to pay for it.
I think that is okay, since I am the patient.
What do the rest of you think?

I got my question answered about putting my relative on as my grower by going to Anthony Johnson of Voter Power, and he is a legal beagle.
It is better to have my family protected at all times. Since my relative does most of the heavy work for me and his wife tends to me when I am sick, I made them my grower and caregiver to protect them from any questionable actions by Law Enforcement.
The last sheriff here said that Medical Marijuana does not exist in Curry County....so there ya go. When rogue cops are on the attack, you must be protective of your helpers, and by filling in their names (and giving them a carded status) I have done that.
Having a card while visiting another's garden, I don't see the beef as long as you HAVE an OMMP status and ID. I will not interpret the law there, and do suggest you consult a lawyer....or the OMMP directly for the FACTS.

I had my renewal clinic appointment yesterday at MAMAs and went ahead and asked about this issue (since I didn't have any other questions). Their legal guy reiterated what's been said here in this thread....that so long as you are a current OMMP cardholder, you are totally good to go in helping others out in their garden.

I have been in many Gardens in our area.
first I check paperwork;)
Some are in compliance and some not.
This is the only time I hesitate to help (when they are not). I tell them that next time I visit, it must be in compliance or I turn around and leave.
other than that, I have no qualms about visiting others Gardens when invited.
and yes..I do have a card:)
