From now on when you fill out the paperwork you can just skip the criminal background form as it is not needed.
They will do a background check automatically on the grower from now on.

Had three done on me in the last 45 days.:D One new patient and 2 renewals.

Seems like a waste of time and resources on the OMMP's part to do the background check every time you renew.

Do not think that they are NOT doing the background checks on the growers EACH and every time your patients come up for renewal. It might cut down on the PAPER WORK....but...

It will NOT cut down on those criminal history checks.....!!

Be sure to let anyone KNOW who wishes to be your grower that is the way it is. This will simply be another entrapment game in a small way to try to catch criminals trying to become growers.

In a recent Fox (PDX) story a month ago they had a big story about an ex con from TEXAS who was a bona fide grower. The man had paid his dues in Texas and the story was a propoganda effort to say that EX CONS are currently growing marijuana in Oregon. Fortunately the station got a lot of calls about that one and their stacked and stilted story. This grower was NOT breaking any Oregon laws there.

OMMA law has provisions for anyone who commits a crime and wants to grow. If you have paid your debt to society it makes no difference at this point. So let's see what falls out of this crack. :BartMooney2: In the end it can turn into a means of entrapment. They are only supposed to check criminal records from Jan 2006, who knows if a previous record will be a good enough reason to persecute and set up a person up for a criminal act.

Just be careful and stay in compliance and let folks know that if they are going to be growing for you, what it entails.

They still run the background checks you just don't have to fill out the form anymore.

It was never even explained through the whole process that any sort of background check would occur. Hmm, that's interesting, I certainly hope that everyone would be honest with you before considering a legal OMM grow with them. In my opinion, I agree with allowing individuals who have paid their debt to society to grow as long as the guidelines are met, it doesn't really bother me if they check backgrounds as long as it is for a legitimate purpose and not for entrapment.

the criminal background check is looking for convictions POST jan 2005.

that doesn't mean they won't find something else if it is there.
The only thing that matters to ones ability to be a prmgs is POST 2005 drug convictions.

They do run a new cbc at renewal in case you were convicted in the preceding year.

I thought it was POST (after or since) Jan 1 2006, when sb1085 became officially part of the OMMA changes.

If I am mistaken please feel free to correct me.

How does being previously convicted become a means of entrapment? I don't follow.

ORS 475.304 (http://www.leg.state.or.us/ors/475.html):

(6)(a) The department shall conduct a criminal records check under ORS 181.534 of any person whose name is submitted as a person responsible for a marijuana grow site. (b) A person convicted of a Class A or Class B felony under ORS 475.840 to 475.920 for the manufacture or delivery of a controlled substance in Schedule I or Schedule II may not be issued a marijuana grow site registration card or produce marijuana for a registry identification cardholder for five years from the date of conviction.
(c) A person convicted more than once of a Class A or Class B felony under ORS 475.840 to 475.920 for the manufacture or delivery of a controlled substance in Schedule I or Schedule II may not be issued a marijuana grow site registration card or produce marijuana for a registry identification cardholder.

I don't know exactly where I stand on the criminal background check.

If there was no bg check, the opponents of medical marijuana would eat it up as ammo for their crusade against mmj.

On the other hand, I think criminals deserve medicine also.

Nothing says a convicted felon can't get medicine....they just can't grow it for 5 years on 1st offense or forever for multiple offenses.

I'll be damned. So a convicted felon could be a patient, but not a caregiver/grower. Ya learn new stuff everyday!

that would be four years before the current law took effect. Of course it wont affect you.
