I have spent the last 5 days reading 75-90% of the posts on this website. My ? when is a person OK to have meds, have plants and not worry about the steel braclets cops carry and use. One member told me as soon as the DR. fills out the paperwork. Another told me when the return receipt for certified mail to DHS in Salem gets to you. Another said when you get the permit from DHS in your hand with your name on it. Someone please clear this up for me and other newbies. Jack...

I went to the THCF clinic in portland and the doctor kept insisting i was legal when i left there. he wasn't completely accurate. I wasn't actually legal until i walked over to the state building and paid my fee and got that receipt. had i not walked it over i would have had to go to the post office and send my payment and paperwork certified mail. once I had the reciept in hand, I would then have been legal.
otherwise its when you get the letter a month later saying everythings in order and they are issueing your cards

1. as soon as the doctor signs, = comfortable
2. when you get the reciept from dhs = no worries at all
as long as you have copies of the completed signed paperwork and your reciept from dhs = no worries in my book

A complete application and proof of mailing has the same legal protection as the OMMP card. HEre is the relevant section from the statute:
ORS 475.309
(9) A person who has applied for a registry identification card pursuant to this section but whose application has not yet been approved or denied, and who is contacted by any law enforcement officer in connection with the person’s administration, possession, delivery or production of marijuana for medical use may provide to the law enforcement officer a copy of the written documentation submitted to the department pursuant to subsections (2) or (3) of this section and proof of the date of mailing or other transmission of the documentation to the department. This documentation shall have the same legal effect as a registry identification card until such time as the person receives notification that the application has been approved or denied.
If a doctor is telling people they are legal when he signs then that doctor is wrong. Some patients have gotten the idea that then they don't need to submit the application. Please educate that doctor! Patients have been arrested because of this.

Thanks to each of you for your answers, especially Rancher for the quote from the law book. I believe I'll wait for the permit itself before the medical marijuana sticker goes on the back of my wheelchair as a conversation starter. Jack...
