To anyone who can help,

I recently applied/interviewed/hired for a janitorial position for linn county. After the job offer I got over the phone, I was sent to samaritan occupational clinic for a Urinalysis. I showed the doctor my medical card and he told me the county falls under Federal guidelines for U.A procedure. He told me he was going to have to send my results to my employer as failed for THC.

I thought that I was covered under state regs and the county fell under these guidelines.

I called my employer before the "results" came back to him and let him know I was A OMMP cardholder. He said he would call me back a few days later. A few days later he called and told me they could not hire me due to dirty U.A.

Here are my questions: What can I do? What options do I have? Can they do this?

Help,

Can any employer take what ever side they want? what about the state? do they have to? after all the state is the one who issued the card

it is literally up to the employer at this point in time. there is a lumber mill near us that will hire cardholders but only for positions that do not require running any machinery. i've HEARD that the state does not drug test but i do not personally know this for a fact. i believe there are other members who can verify this. other members have discreetly disclosed they are cardholders and the company was able to make concessions. give this thread a couple of days and you'll hear from some other people who have direct experience with this issue.

The state does not test, at least in the DHS department. Maybe for state police. Apply at the state.
